Capitalist Legal System

for some people, every day is a rainy day. especially if they are lucky enough to live in the USA.

This country is shaped by the people, questor. By my criticism, I am hoping our system will improve, because I know without the heartbeat of proactive citizens, this country will decay like a lifeless corpse.

if you want to criticise something, why not take on pork barrel politicians, lobbyists, the liberal NEA who are in charge of our failing school system, criminals, the welfare system,

bloated government with too many entitlement programs, political correctness, negative cultures which demean and destroy morality and drag others down with them? this is just a short list to get you started.

for those of you who think the state is always wrong and the perp is always right, why not refuse to have police and courts in your jurisdiction? you can get a tax break and enjoy the fruits of criminal capitalism.

I dont know if you were referring to my post, but I am going to respond anyways.

Its not about letting the guilty get off without penalty, its about the misjustice that is all to rampant in a country like the USA. I expect prosecutors, police, expert witnesses, lab techs, etc to hold to a higher standard than the person on trial. I want my police to ensure that justice is served. I want prosecutors to hold the law in the highest regard. I expect the system to strive for perfection and I wont let it lapse because "Hey, its not as bad as it is in mexico...." I would like to see a bit of zero tolerance towards these crimes against people. An innocent person in prison affects the whole family more than you may realise.

I am appalled anytime I read a story on cnn, see it in my paper, hear it on the radio, when another innocent person is released, and the cause of his/her incarceration is due to misconduct by these persons who are paid to do a better job than that. I also find it repulsive the lack of penalty when such things occur, when it is shown that some kind of willful misconduct on the Laws side of the story is the cause of these gross headlines. There is too little done to hold these persons responsible for their actions. And it is these miscarriages I was refering to with my idea on how to balance "justice for all".

Check out this site page about misconduct:

http://www.truthinjustice.org/p-pmisconduct.htm

Same site with info on at least some of the many innocent released (not all due to intentional misconduct, but including charges that should have never been brought):

Thanks for clarifying. That's what I thought you meant. Apparently, advocacy for change can be misconstrued as pot-head complaints.

One must also realize that even today there are racial biased laws... The drug war is a good example...In Texas, 5 grams of crack cocaine is a 1 year min. sentence. 50 grams of powder cocaine is a minimum 1 year sentence... The moral of the story...guess what... Crack is a more "urban" drug (ie more common in non-white urban populations), powder cocaine is predominantly used by whites... As 2004 stats about prison populations...about 70% of inmates from drug convictions are African American, yet it estimated that 70% of drug offenses are perpetrated by whites...

A nice little picture of our still racial bias in law and the ineptness and inaccuracy in the "Drug War".

I actually agree, Fish.

I used to think the politicians were crooked. Now I just think their literally too stupid to write sensible laws. (See 3848 thread) They're like CEO's on steroids. And even when politicians purposefully write biased legislation, I think they're too stupid to realize they're corrupted by their greed also.

Those items are merely symptoms of the problem. Capitalism appears to be a sound system but it assumes all are created equal. The problem is our society allows and even encourages the strong to victimize the weak. The goal is profit which can only be obtained at someone else's expense. If that someone else had an equal service or product to trade, all would be fair but that's not the case. As humanists, we should recognize and amend the difference as best we can. Some entitlement programs could work if they were not driven by the political and economic motives of capitalism. The true nature of humans is communism although it can only function on small scales and without corruption. (Good luck!)

Na, entitlement kills capitalism. Why work when you can not ? The driving force behind a self-motivated economy is the need, not the want. Provide a safety net and someone will say, "Oh look, a hammock!"

The other thing killing capitalism is lobbyism. Legal bribery keeps the politicians interested in what the corporations want instead of the will of the people. Add entitlement, and poof, we have a quasi-capitalist/pseudo-socialist government. Capitalism without the democracy, and socialism without the mandatory work assignments and without politicians being accountable for poverty. Pretty ingenious.

Capitalism does NOT think people are created equal. it DOES give them the opportunity to

create their own happiness. this is difficult to do when you are weighted down by the parasites who will not work. i would think a person who wants communism or socialism

is stuck in a low paying job, without the ambition to create their own wealth.
